What Determines The Value Of Fractured Or Broken Jaw Compensation?

The type of injury you have suffered, its severity, and whether there are related financial losses are some of the factors that determine the value of fractured or broken jaw compensation.

Specifically, your solicitor will calculate how much you are owed in general damages, which is a head of claim that covers pain and suffering. These damages aren’t limited to physical effects alone, but also the psychological impact of an injury.

General damages will take into account:

  • The severity of your broken jaw injury and any related psychological distress, such as depression or PTSD
  • Whether you will encounter any pain and suffering in the future
  • Any impacts on your quality of life, such as difficulties with eating or speaking
  • The presence of disfigurement or deformity
  • Whether you have needed invasive treatment

You can discuss the specifics of general damages with an advisor right away, so get in touch for a free consultation today.

Can Fractured Jaw Compensation Cover Other Losses?

Yes, fractured jaw compensation can cover the cost of private treatments, professional carers, and other financial losses stemming from an injury, under a second head of claim called special damages.

Have a look at some other examples of financial losses below:

  • Loss of wages, including bonuses and reduced earning potential
  • Care from family members and friends
  • Additional help with childcare
  • Travel expenses incurred while attending medical appointments
  • Medical expenses, for example, prescription fees
  • Beakers, nutritional supplements, blenders, and other purchases necessary after a fractured jaw

To include special damages as part of your fractured jaw compensation, you will first need to prove that you have incurred financial losses. This involves supplying evidence in the form of documented costs, such as payslips, invoices, and receipts.

Can I Claim Compensation For A Broken Or Fractured Jaw?

You can claim compensation for a broken or fractured jaw if you are able to prove that your injury was a result of a third party’s negligent actions. In order to do so, you must meet the following eligibility criteria:

  1. A third party, such as your employer or another road user, owed you a duty of care
  2. This duty was breached
  3. The breach resulted in you suffering a fractured jaw

In everyday situations, various pieces of legislation set out third parties’ responsibilities to protect our safety. This legal obligation is the duty of care referred to above and can be set out in laws like the Health and Safety at Work etc. Act 1974 and the Occupiers’ Liability Act 1957. When such legislation is not followed, causing a fractured jaw or other injury, claims may be made.

We understand that you may have questions regarding how a duty of care might be breached. Don’t worry, we discuss this in more depth later on in our guide.

If you have any immediate questions about the eligibility criteria for your jaw injury compensation claim, please feel free to contact an advisor straight away.A woman holding the side of her face in pain which is highlighted by a red glow.

How Might A Fractured Jaw Injury Occur?

A fractured jaw injury might occur due to significant force or trauma to the face, such as in road traffic collisions, slips on wet floors in public places, and falls from a height at work. We’ve provided you with some examples of accidents below:

Accident At Work

While you’re at work, your employer has a legal obligation to take reasonable steps to ensure your safety, health, and well-being. It is when this duty is breached and an injury at work results that a claim can be made. For example:

  • An employer provides a worker with a faulty ladder to stack some shelves in a warehouse. The ladder breaks mid-use, causing the employee to fall from a height and suffer a condylar fracture and a broken eye socket.

Road Traffic Accident

All road users owe one another a duty of care to drive safely to avoid injury to themselves and others. This also requires motorists, pedestrians, and everyone else on the road to follow the Road Traffic Act 1988 and the Highway Code.

If they fail to meet this duty and someone gets hurt, such as in the following scenario, then a road traffic accident claim could be made:

  • A drink driver collides with the back of another car, causing the motorist in front to slam their jaw against the steering wheel. This results in a symphysis fracture and broken front teeth.

Public Liability Accident

When you are in a public place, the occupier (the party in control of the space) has a responsibility to use practical measures to ensure your reasonable safety while visiting. A public liability claim can be made if the occupier fails to uphold this legal duty and an injury results, such as:

  • A train station has failed to clean up a large spill or post a wet floor sign in a timely manner. A passenger slips and hits their face against a ticket barrier, leaving them with a comminuted fracture to the side of their jaw.

Medical Negligence

Every patient is owed a duty of care from the moment a medical professional agrees to treat them. This duty translates into an expectation of providing a minimum standard of care. If it is not, and a patient experiences unnecessary or avoidable harm, then a claim can be made. For instance, medical negligence might involve:

  • A radiologist fails to spot a patient’s ramus fracture during an X-ray, leaving the patient untreated. Consequently, the patient suffers from a facial deformity and chronic pain.

Criminal Injury

If you have been injured as a result of a violent crime in England, Wales, or Scotland, you may be able to claim compensation for a criminal injury through the Criminal Injuries Compensation Authority (CICA). The CICA is a government-funded scheme that compensates victims of violent crime when other avenues of claiming are not open to them.

Compensation is awarded in line with a fixed tariff as set out in the Criminal Injuries Compensation Scheme 2012. Unlike in personal injury and medical negligence cases, the time limit for starting a CICA claim is usually 2 years from the date of the incident, although exceptions may apply.

For example:

  • A man walking home from work is attacked and punched repeatedly in the face, resulting in them suffering a dislocated jaw and multiple fractures.

What Is Needed When Claiming Compensation For A Jaw Fracture?

Sufficient evidence to support your account of what happened, such as your medical records, and adhering to the legal time limit, is needed when claiming compensation for a jaw fracture.

When it comes to evidence, the more proof you are able to present, the stronger your fractured jaw claim will be. This is because it validates your version of events that a third party is responsible for your injury. For example, you could provide photographs of the fracture and CCTV footage of the accident happening. Read our guide on how to prove negligence, which provides more guidance on different types of evidence.

In terms of time limits, you typically have 3 years from the date of the incident to begin claiming. This is referred to as the limitation period, which is set by the Limitation Act 1980. With that said, there are exceptions that may apply. To find out more, please read our guide on the limitation period.

Not only are our advisors ready to provide further on time limits, but a solicitor from our panel can also gather evidence on your behalf. To find out more about this help, please get in touch today.

Speak To How Much Compensation To Start A Claim

  • You pay nothing towards the solicitors’ service fees throughout the entire claims process
  • If your fractured jaw claim fails, you still pay nothing in service fees

If the claim wins, you will pay a small success fee directly from your fractured jaw compensation in the form of a legally capped percentage, as outlined in the Conditional Fee Agreements Order 2013. This means, no matter what, you will take home the largest share.
