What Is The Time Limit For A Child’s Compensation Claim?
Children can’t make their own claims. Because of this, you can make a claim on behalf of an under-18 as their litigation friend. This means that the usual limitation period doesn’t apply, and you can start the process at any point up until their 18th birthday.
After that, if you haven’t made a claim on their behalf, they will have to make their own claim. They will have 3 years to start this process, from their 18th birthday to their 21st birthday.

The Limitation Period For Vulnerable Adults
For vulnerable adults or those who lack the mental capacity to make their own claim, the time limit doesn’t apply. A litigation friend can make a claim on their behalf whenever they want to, unless they recover, which isn’t always possible. Should the vulnerable adult recover this capacity, then the limitation period is counted from this date and they will have 3 years to start a claim.

Yes, the time limit is the same for medical negligence claims. However, instead of solely beginning on the date of your injuries, medical negligence claims also use the date of knowledge. This means the 3-year time limit will begin either on the date the harm occurred or on the date that you connect the harm you’ve been through with the negligent actions or inactions of a medical professional.
What Is The Time Limit For A Fatal Accident Claim?
If you are looking to make a fatal accident claim, the same 3-year limitation period applies. However, according to the Law Reform (Miscellaneous Provisions) Act 1934, the first six months of this limitation period are reserved for the deceased’s estate.
